Terms of Service

These Terms of Service ("Terms") govern your use of the AnswerBot service operated by AnswerBot ("we," "us," "our"). By subscribing to or using AnswerBot, you agree to these Terms.
1. Service Description
AnswerBot is an AI-powered missed-call text-back and lead recovery service. When a call to your business goes unanswered, our system automatically sends an SMS to the caller, engages in an AI-driven conversation, qualifies the lead, and delivers a summary to you. AnswerBot does not book appointments, access your calendar, or commit to pricing or availability on your behalf. The business owner is responsible for all follow-up contact.
2. Eligibility
AnswerBot is available to businesses in Canada and the United States. You must be at least 18 years old and authorized to act on behalf of the business you register. You are responsible for ensuring your use of the service complies with all applicable federal, state, and provincial laws, including laws governing automated text messaging in your jurisdiction.
3. Account and Subscription
- All plans begin with a 14-day free trial. A valid credit card is required at sign-up to verify your account.
- After the trial period, your selected plan will be billed monthly via Stripe.
- You may upgrade, downgrade, or cancel your subscription at any time through the Stripe Customer Portal. Cancellations take effect at the end of the current billing period.
- Engaged lead limits apply per billing cycle. An "engaged lead" is a caller who replies to the automated text-back. Unused leads do not roll over.
- The Pro plan includes unlimited engaged leads.
- Current pricing is listed at answerbot.ca/#pricing. Prices are in Canadian dollars (CAD) unless otherwise stated.
4. Acceptable Use
You agree not to:
- Use AnswerBot to send unsolicited commercial messages or spam
- Provide false or misleading business information
- Use the service for any unlawful purpose
- Attempt to circumvent lead limits or billing controls
- Interfere with or disrupt the service infrastructure
- Use the service to contact individuals who have previously opted out
5. CASL Compliance
AnswerBot is designed to comply with Canada's Anti-Spam Legislation (CASL). All automated messages include a bilingual opt-out mechanism (STOP/ARRET). You acknowledge that:
- Text-back messages are sent based on implied consent from the caller's missed call (valid for 6 months under CASL).
- You are responsible for not using AnswerBot to contact individuals who have opted out or for whom you do not have valid consent.
- We automatically suppress contacts who reply STOP or ARRET.
6. SMS Program Terms
The following terms apply to all text messages sent through the AnswerBot platform:
- Program name: AnswerBot Missed-Call Text-Back
- Message frequency: Message frequency varies. Recipients will receive one or more messages per missed call based on their conversation with our automated system.
- Message and data rates may apply. Recipients should check with their wireless carrier for details on applicable charges.
- To opt out: Reply STOP to any message to immediately stop receiving messages from that business. Reply ARRET for French opt-out. No further messages will be sent after opt-out is confirmed.
- To get help: Reply HELP to any message. You will receive contact information for the business or AnswerBot support.
- AnswerBot sends messages on behalf of our business subscribers. If you have a complaint about a specific message, contact the business directly or email info@answerbot.ca.

- Carriers are not liable for any delayed or undelivered messages.
7. AI-Generated Content
AnswerBot uses artificial intelligence to generate text-back responses. While we design the AI to be professional and accurate, you acknowledge that:
- AI responses may occasionally contain errors or inappropriate content.
- The AI will not make pricing commitments, book appointments, access calendars, provide medical or legal advice, or guarantee specific availability on your behalf.
- AnswerBot captures lead information and sends you a summary. All follow-up, scheduling, and booking is your responsibility as the business owner.
- You may review flagged conversations and adjust your greeting style at any time.
- We are not liable for business decisions made based on AI-generated lead classifications.
8. Data and Privacy
Your use of AnswerBot is subject to our Privacy Policy. You acknowledge that caller phone numbers, message content, and lead data are processed and stored as described therein.
9. Service Availability
We strive for high availability but do not guarantee uninterrupted service. Planned maintenance, third-party outages (Twilio, Supabase, Stripe), and force majeure events may cause temporary disruptions. We will notify subscribers of planned downtime when possible.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT ALL MISSED CALLS WILL BE CAPTURED AND RESPONDED TO. THE RESULTS OF USING THE SERVICE, INCLUDING LEAD GENERATION AND CONVERSION RATES, ARE NOT GUARANTEED.
11. Limitation of Liability
To the maximum extent permitted by law, AnswerBot's total liability for any claim arising from the service is limited to the fees you paid in the 3 months preceding the claim. We are not liable for lost revenue, missed leads, missed calls, failed SMS deliveries, or indirect damages resulting from service use or unavailability.
12. Indemnification
You agree to indemnify, defend, and hold harmless AnswerBot and its officers, directors, employees, and agents from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the service in violation of these Terms; (b) your violation of any applicable law or regulation, including CASL, TCPA, or applicable provincial and state telemarketing laws; (c) any claim by a third party that your use of AnswerBot harmed them; or (d) false or inaccurate information you provided during registration.
13. Termination
We may suspend or terminate your account if you violate these Terms, fail to pay subscription fees, or use the service in a manner that harms other users or our infrastructure. You may cancel at any time. Upon cancellation, your data will be retained for 90 days and then automatically deleted, unless required by law (CASL consent records are retained for 3 years).
14. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the service after changes take effect constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes will be resolved in the courts of Ontario. If you are a US-based subscriber, you agree to submit to the jurisdiction of Ontario courts for resolution of any dispute arising from these Terms.
